2. The Program
BillingMart is software for businesses to bill their customers. A business that uses BillingMart (a "Business") may send you text messages about your account with it through BillingMart's messaging service. Every message begins with the Business's name and ends with "Reply STOP to opt out". Messages from many Businesses may come from the same BillingMart number.
These terms apply to every text message sent through BillingMart, together with the Terms of Service and the Privacy Policy.
3. What We Send
- Notices about invoices and estimates a Business has sent you, payment reminders, receipts, statements and refund confirmations, usually with a secure link to view the record.
- Short messages a Business writes to you about your account with it.
- One-time codes that verify your phone number.
- A single confirmation when you opt out.
The program is for account and transaction messages. It is not for emergencies or other time-critical communication; do not rely on a text message for anything that cannot wait.
4. How You Join
No message other than a verification code is sent to a number until both of these have happened:
- The number is verified. We text a one-time code to the number and it is entered back, so we know the number belongs to the person using it.
- You give explicit consent. You choose to receive text messages from that Business, for example by ticking a box when you verify your number. Consent is recorded with the time it was given. Consent is never a condition of purchasing anything.
A Business may also be responsible for collecting your consent itself before it asks you to verify. Consent to texts from one Business is not consent to texts from another.
5. How to Stop
Reply STOP to any message. STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT work the same way. Your opt-out takes effect promptly, applies to every Business that holds your number on BillingMart, and you will receive one message confirming it.
Replying START does not resume messages. To receive texts again you must opt in again through a Business, as described above. Stopping texts does not cancel any account, invoice or payment, and a Business may still contact you by email or other means allowed by law.
6. Getting Help
Reply HELP (or INFO) to any message for a short description of the program and how to opt out. For questions about a message from a Business, contact that Business. For questions about the program itself, use our Contact page.
7. Costs, Frequency and Delivery
- BillingMart does not charge you for text messages. Message and data rates may apply under your mobile plan; you are responsible for them.
- Message frequency varies with your activity and the Business's billing. Messages are limited in rate per Business.
- We do not guarantee delivery. Messages may be delayed or not delivered because of your device, coverage, carrier filtering, a changed number or other causes outside our control. Mobile carriers are not liable for delayed or undelivered messages, and to the fullest extent the law allows, neither is BillingMart.
- If you change or give up your phone number, opt out first or tell the Business, so messages are not sent to the number's next holder.
8. Responsibilities of Businesses
A Business that sends text messages through BillingMart decides whom it messages and what it says, and is solely responsible for complying with the Telephone Consumer Protection Act, state telemarketing and messaging laws, carrier rules and the Acceptable Use Policy, including obtaining and documenting consent. BillingMart transmits messages on the Business's instructions and does not review their content. BillingMart may refuse, limit or suspend messaging for any Business or number at its discretion, including to prevent abuse or to comply with carrier requirements.
9. Your Phone Number and Privacy
We use your mobile number to deliver the messages described here and to honor your opt-out. We do not sell your mobile number or your text-messaging opt-in, and we do not share them with third parties or affiliates for their own marketing. We share them only with the service providers that deliver messages for us, under contract. Message records keep the last four digits of the number, not the whole number. See our Privacy Policy and US State Privacy Rights.
10. Eligibility and Your Representations
By opting in you confirm that you are at least 18 years old, that you are the subscriber of the mobile number or are authorized by the subscriber to opt in, and that you will tell the Business if the number changes. You agree not to use the program for any unlawful purpose.
