Residents of states with their own privacy laws have the rights described in our [US State Privacy Rights](https://billingmart.com/privacy/states) notices; everyone else may use this form too. ## 2. What Happens Next 1. We email a confirmation link to the address you gave. The request is not processed until you open it, and it expires after 7 days. 2. Once you confirm, we email you a reference number and the date we will respond by, which depends on your state's law. 3. We verify your identity by matching your details against our records, and may ask for more information. We cannot act on a request we cannot verify. 4. We respond by email, telling you what we did and, if we kept or could not act on anything, why. ## 3. What We May Keep Some information must or may be kept even after a deletion request, as the law allows, for example to complete a transaction, keep financial, tax and payment records, prevent fraud, secure the service, comply with the law, or establish or defend legal claims. Data removed from live systems leaves our backups as they age out. Each [state notice](https://billingmart.com/privacy/states) lists these exceptions. ## 4. Records Held for a Business If a business that uses BillingMart bills you, your invoices, estimates, payments and receipts are that business's records, and BillingMart holds them on its behalf. We may pass a request about them to the business and tell you we have done so; the business decides how to answer it. Naming the business on the form helps us do that. ## 5. Other Ways to Reach Us If you cannot use this form, use our [Contact page](https://billingmart.com/contact) and say it is a privacy request. This form is for privacy requests only; legal process, such as a subpoena, is not accepted through it. ## 6. Disclaimers, Limitation of Liability and Indemnification This section restates, and this page incorporates by reference, Sections 10 (Warranties and Disclaimers), 11 (Limitation of Liability) and 11A (Indemnification) of the [Terms of Service](https://billingmart.com/terms#disclaimers) . They apply to everything this page describes, to the fullest extent the law allows, and the Terms of Service control if the two differ. Where applicable law does not permit a disclaimer, limitation or exclusion below, it applies to the extent the law permits. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER THE TERMS OF SERVICE OR THIS PAGE SHALL BE STRICTLY LIMITED TO THE TOTAL FEES PAID BY YOU TO BILLINGMART IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, WHICH MAY BE ZERO. **Indemnification.** The indemnity in [Section 11A of the Terms of Service](https://billingmart.com/terms#indemnification) — your defense and indemnification of the BillingMart Parties against claims arising from your use of the Services, the content you send, your dealings with your customers and the consents and notices the law requires of you — applies to the activities this page describes as if set out here in full.
